14.  DISPUTE RESOLUTION

The mediation will be facilitated by a neutral mediator selected by mutual agreement of the parties. The costs associated with the mediation process will be shared equally by both parties, unless otherwise agreed. The mediation will be conducted in a mutually acceptable language and in a location agreed by the parties, preferably virtually to ensure accessibility.

If, after a reasonable period of time, the mediation does not lead to a mutually satisfactory solution, any outstanding dispute will be resolved by binding arbitration. The place of arbitration shall be Austria. The arbitration will be conducted in English, unless otherwise agreed by both parties, and the arbitral award will be final and binding on both parties. The parties expressly waive any right of appeal or recourse, except to the extent permitted by applicable law.

The parties also agree that each of them shall bear its own legal costs in relation to the arbitration, unless the arbitrator determines otherwise in his or her award. Dubai Properties and the client recognize that arbitration will be the only recourse for resolving disputes that are not resolved by mediation, and waive the right to bring any claim before the courts, except to the extent necessary to enforce the arbitration award or to seek injunctive relief before or during the arbitration proceedings.

By accepting these conditions, both parties confirm their commitment to resolving any dispute efficiently, confidentially and fairly in accordance with the principles established in this clause.

15.  APPLICABLE LAW AND JURISDICTION

These terms and conditions shall be governed by and construed in accordance with the laws of the European Union. Any dispute relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Austria. This applies unless binding arbitration is agreed in the relevant section.

16.  FINAL PROVISIONS
